Agreement to Terms of Storage

This Winter Trailer Storage Service Agreement ("Agreement") is entered into by and between Motopark ("the Company") and the undersigned trailer owner ("Customer") on the date signed below. The Customer agrees to the following terms and conditions for the storage of their trailer ("Vehicle"):

Service Period

The service period will commence on November 1, 2023, and will conclude on March 31, 2024 ("Storage Term").

Limited Access

The Customer acknowledges and agrees that access to the stored Vehicle may be limited during the Storage Term. The Company does not provide snow plowing services, and as such, the access ways to the stored Vehicles may be obstructed by snow or ice during the winter months.

Customer Responsibilities

Insurance: The Customer is solely responsible for maintaining adequate insurance on the Vehicle at all times during the Storage Term, including comprehensive coverage for theft, vandalism, windstorm, snow, ice, and any other potential damages.

Indemnity: The Customer agrees to indemnify and hold harmless the Company from any claims, liabilities, losses, damages, or expenses resulting from the storage of the Vehicle.

Company's Limitation of Liability

The Customer agrees that the Company shall not be liable for any damage or loss to the Vehicle caused by any of the following:

• Wind, Snow, Theft, or Vandalism.

The Company is also not responsible for any damage that may occur due to the natural settling of the ground, or any other natural disasters.

Security

While the Company will take reasonable precautions to secure the storage area, it is expressly understood that the Customer stores their Vehicle at their own risk.

Payment

The Customer agrees to pay $398.23 + HST ($450) for the Storage Term. Payment is due in full upon execution of this Agreement.

Termination

This Agreement is binding for the entire Storage Term. Early termination by the Customer will not warrant any refund of payment.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the province in which Motopark is located.

Entire Agreement

This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all previous agreements, promises, proposals, representations, understandings, and negotiations, whether written or oral, between the parties respecting the subject matter hereof.

Acknowledgment

BY SIGNING BELOW, the Customer acknowledges that they have read and understand this Agreement and agree to all terms and conditions outlined herein.
